Estate Planning

Estate planning starts with an in depth interview to determine your goals and wishes, as well as the nature and extent of your assets.  A will or a trust are the usual devises used when beginning the planning process, but there are other important documents you may want to consider as well. Powers of Attorney, both general and for healthcare, and advanced directives are other devices used in estate planning.
The attorneys at the Law Office of Kelley Hinsley can help you consider all the issues involved in preparing these important documents. We take the time to understand you, your family situation, and your goals in estate planning. We work closely with our clients to prepare:

  • Wills
  • Trusts, including revocable and irrevocable trusts
  • Powers of Attorney, including general powers of attorney for financial decision making, and powers of attorney for healthcare naming a health care surrogate to make medical decisions for you.

Elder Care and Medicaid Planning

When you enter the golden years, it is nice to enjoy retirement and grandchildren, but it is also essential to plan for long term care.  Elder care planning focuses on preparing you for long term care by ensuring that your assets are protected, and powers of attorney and advanced directives are prepared.  The protection of your assets is essential in the event Medicaid benefits are needed for nursing home care.

Medicaid benefits are only available to those with very limited monthly income; if your income from any source is too high, you will generally not be able to qualify for Medicaid benefits. However, a Qualified Income Trust (also known as a Miller Trust) may enable you to qualify for nursing home Medicaid benefits despite your income.

The attorneys at the Law Office of Kelley Hinsley have extensive experience preparing Miller Trusts. The attorneys stay current with the latest regulations regarding Medicaid eligibility and Medicare benefits and can help you plan for your future care or the care of someone you love.
